Abstract

SUMMARY Fhaorozhe Rezky Hakim 190510101 Implementation Of The Fulfillment Of The Rights Of Women Prisoners In Prisons (Research Study In Class II A Medan Women’s Prison) (Johari, S.H., M.H. and Ferdy Saputra, S.H., M.H.) Female prisoners have special rights that are inherent in them due to their reproductive function, therefore they must be protected by law. Although they are sentenced to loss of liberty (imprisonment) which limits their freedom of movement, their basic human rights remain inherent because it is a gift from God Almighty (1945 Constitution Article 28 G paragraph (1)). Law No. 22 of 2022 regulates the implementation for prisoners, especially female prisoners who are naturally different from men, of course in this case, even though their status as prisoners, women must still be treated differently, for example when female prisoners are pregnant and breastfeeding. Based on initial research at the Class IIA Medan Prison, it was found that the implementation of inmates' rights is still a major problem that is closely related to the rights of inmates, especially regarding service, comfort, and eligibility. This study uses an empirical research type, a statutory approach and a conceptual approach, a descriptive research nature, primary and secondary data sources, the research location was conducted at the Class IIA Medan Women's Penitentiary. The results of the study indicate that the fulfillment of the rights of female prisoners in Class IIA Medan Penitentiary in general has not been fulfilled by the relevant institutions but still has several obstacles such as when female prisoners who are pregnant do not receive adequate health facilities and female prisoners who are breastfeeding are constrained in the lactation room and several obstacles must be fixed by the Prison, both in terms of facilities and qualified health worker partners and the Prison is advised to collaborate with the public service implementation work unit so that a comfortable lactation room can be realized that meets standards. The conclusion is that the fulfillment of the rights of female prisoners in Class IIA Medan Penitentiary as a whole has not been carried out properly. Then the obstacle in implementing the fulfillment of the rights of female prisoners lies in inadequate health facilities and other obstacles. The advice that the author can give is to all parties, especially the Prison, to improve adequate health facilities and rooms. Then for work partners that must be added, especially additional health workers. So that it is hoped that the fulfillment of the rights of female prisoners in Class IIA Medan Women's Prison can increase, providing a positive impact on the health, welfare, and sense of security of prisoners while serving their sentences.
