Abstract

Houses of worship are facilities used by religious people in carrying out worship in accordance with their beliefs, the state certainly guarantees the rights of citizens to establish houses of worship even though their establishment must be in accordance with applicable laws and regulations, such as the Joint Regulation of the Minister of Religion and the Minister of Home Affairs No. 8 of 2006 and Aceh Qanun No. 4 of 2016 concerning guidelines for maintaining religious harmony and establishing places of worship. In 2015 to 2019 there was a rejection of the establishment of the Taqwa Mosque Muhammadiyah until then there were various polemics in the community. Based on the description above, the formulation of the problem in making this thesis is how the procedure for granting a building permit for a mosque as a house of worship and the efforts made by the Bireuen Regency government to anticipate the rejection of the Building Permit to the Taqwa Muhammadiyah Samalanga Mosque construction committee. The purpose of this study was conducted to determine the procedure for granting a Building Permit for a mosque as a house of worship, and to find out the efforts made by the Bireuen Regency Government to anticipate the rejection of the Building Permit that has been given to the Taqwa Muhammadiyah Samalanga Mosque Development Committee. The method used in this research is a sociological juridical method through a case approach using library methods and interviews. The research method using the Juridical Sociological Method is descriptive in nature which will describe the object systematically, factually, and carefully. From the results of this study indicate that the granting of IMB to the construction committee of the Taqwa Mosque Muhammadiyah Samalanga experienced delays caused by conflicts that arose due to the construction of a mosque that was carried out not in accordance with the Building Permit procedure. In this thesis, the conclusion will be that the Taqwa Muhammaddiyah Mosque which received a policy in the form of a decision of the Head of the Investment, Trade, Cooperatives and SMEs Office of Bireuen Regency Number 63 of 2017 concerning the Granting of a Building Permit to the Taqwa Muhammadiyah Samalanga Mosque Development Committee, which basically the development committee did not meet the requirements for obtaining a Building Permit so that there was a rebellion by the local community who opposed the construction of the Taqwa Muhammadiyah Samalanga Mosque, and the Bireuen Regency Government and all its staff immediately took action to issue a decision to delay the implementation of the construction of the Taqwa Muhammadiyah Samalanga Mosque.
