Abstract

Abstarak Undang-undang Nomor 16 Tahun 2014 tentang Desa dan dan Dana Desa Pada pasal 37 ayat 5 menyatakan bahwa proses penyelesaian sengketa kepala desa diserahkan kepada Bupat/Walikota masing-masing. Namun hal ini kemudian menjadi kendala ketika proses tersebut diserahkan kepada penjabat daerah, khususnya bagi masyarakat yang terkait seperti pada permasalahan di desa Ujung. Tujuan dari penelitian ini adalah untuk menganalisis bagaimana proses penyelesain sengketa di desa ujung, faktor-faktor yang menjadi penghalang proses penyelesaian sengketa ini dan upaya apa saja yang telah dilakukan untuk mengatasi persoalan ini. Penelitian ini menggunakan jenis Yuridis Empiris yaitu penelitian penelitian secara lapangan, yang mengkaji ketentun hukum yang berlaku serta yang telah terjadi didalam kehidupan masyarakat.Penelitian ini bersifat Presfektif yaitu menemukan dan menggali pokok permasalahan sampai keakar-akarnya. Hasil dari penelitian ini menunjukkan bahwa penyelesaian sengketa pemilihan kepala desa di desa ujung kabupaten aceh singkil, menggunakan peraturan bupati no 17 tahun 2021 tepatnya pada pasal 40 yang mana menjelaskan bahwa proses ini di selesaikan oleh camat dan imam mukim, namun dalam prosesnya dilimpahkan juga kepada bupati, kemudian bupati mengangkat calon yang terpilih. Adapun yang mempengaruhi proses penyelesaian sengketa ini adalah masyarakat yang kelompoknya kalah merasa ada kecurangan ketika proses ini penyelesaian timbul anggapan bahwa aturan yang berlaku tidak menjadi satu anggapan bahwa hukum itu adil, dikarenkan mereka manggap aturan yang ada masih mengambang. Upaya yang dilakukan adalah denagan proses mediasi dari tingkat bawah sampai pada tingkat atas dan calon yang menang menawarkan jabatan kepada pihak yang kalah walaupun pada akhirnya di tolak oleh yang bersangkutan dengan alasan tidak etis. However, this later became an obstacle when the process was handed over to regional officials, especially for the communities involved, such as the problems in Ujung village. The aim of this research is to analyze the dispute resolution process in Ujung Village, the factors that hinder the dispute resolution process and what efforts have been made to overcome this problem. This research uses an Empirical Juridical type, namely field research, which examines applicable legal provisions and what has happened in people's lives. This research is perspective in nature, namely finding and exploring the main problem to its roots. The results of this research show that the resolution of disputes over the election of village heads in the edge villages of Aceh Singkil district uses Regent Regulation No. 17 of 2021, precisely in Article 40, which explains that this process is completed by the sub-district head and the mukim imam, but the process is also delegated to the regent. , then the regent appoints the selected candidate. What influences the process of resolving this dispute is that the people whose group lost felt that there was fraud. During this resolution process, there was an opinion that the applicable rules did not constitute an assumption that the law was fair, because they thought that the existing rules were still up in the air. The efforts made were a mediation process from the lower level to the upper level and the winning candidate offered the position to the losing party even though in the end the person concerned rejected it for unethical reasons.
