Abstract

Komisi Independen Pemilihan Kota Lhokseumawe diberikan wewenang oleh undang-undang sebagai penyelenggara pemilihan umum dan pilkada di Aceh memastikan setiap orang punya hak yang sama dalam menentukan pilihannya, termasuk pemilih disabilitas. Hal ini berdasarkan pada Undang-Undang nomor 7, tahun 2017, UU No.8 tahun 2016, PKPU No.3 Tahun 2022, dan Peraturan DKPP No.2 tahun 2017. Sehingga KIP dalam hal ini harus memenuhi hak pilih dan akses pemilih disabilitas pada pelaksanaan pemilu, khususnya pada pelaksaanaan pemilu serentak yang baru saja dilaksanakan yakni pada pemilu tahun 2024. Penelitian ini bertujuan untuk mengetahui peran KIP Kota Lhokseumawe dalam memenuhi hak pilih dan aksesibilitas bagi pemilih disabilitas mulai dari tahap penyusunan daftar pemilih hingga pelaksanaan pencoblosan di TPS guna memastikan semua pemilih disabilitas yang dikategorikan KPU haknya terpenuhi. Penelitian ini merupakan penelitian normatif dengan pendekatan kualitatif yang bersifat deskriptif serta melalui sumber hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa KIP Kota Lhokseumawe punya dua peran yang dilakukan yakni peran normatif dan peran faktual. Peran normatif merupakan implementasi peraturan perundang-undangan yang berlaku mulai dari undang-undang pemilu secara umum, serta Qanun Aceh tentang pemilu. Sedangkan peran faktual adalah peran yang berdasarkan pada kenyataan di lapangan. Pemenuhan hak pilih dan aksesibilitas bagi pemilih disabilitas punya beberapa kendala baik itu dari faktor internal dari KIP sendiri maupun faktor eksternal, yakni dari pemilih disabilitas itu sendiri. Namun, pihak KIP Kota Lhokseumawe telah menjalankan kedua tugas tersebut dengan cukup baik seamanah peraturan perundang-undangan. Hak pilih dan hak aksesibilitas merupakan kedua hak pemilih disabilitas yang wajib dipenuhi oleh KIP Kota Lhokseumawe. Dalam hal ini, KIP Kota Lhokseumawe memiliki beberapa kendala dan upaya yang telah dilaksanakan. Untuk meningkatkan peran KIP dalam memenuhi hak pilih dan aksesibilitas disarankan agar KIP lebih memperkuat koordinasi dengan lembaga terkait, termasuk pelatihan bagi petugas pemilu tentang cara melayani pemilih disabilitas dengan baik. Diharapkan pula agar masyarakat lebih sadar akan pentingnya inklusi sosial dalam pemilu, sehingga pemilih disabilitas dapat menyalurkan hak pilih mereka secara maksimal. This is based on Law number 7 of 2017, Law No. 8 of 2016, PKPU No. 3 of 2022, and DKPP Regulation No. 2 of 2017. So that KIP in this case must fulfill the voting rights and access of voters with disabilities in the implementation of elections, especially in the implementation of the simultaneous elections which have just been held, namely in the 2024 elections This research aims to determine the role of Lhokseumawe City KIP in fulfilling voting rights and accessibility for voters with disabilities, starting from compiling voter lists, to carrying out voting at polling stations to ensure that all disabled voters categorized by the KPU have their rights fulfilled. This research is normative research with a qualitative, analytical descriptive approach and through primary, secondary and tertiary legal sources. The research results show that the Lhokseumawe City KIP has two roles, namely a normative role and a factual role. The normative role is the implementation of applicable laws and regulations starting from election laws in general, as well as the Aceh Qanun regarding elections. Meanwhile, factual roles are roles that are based on reality on the ground. Fulfillment of voting rights and accessibility for disabled voters has several obstacles, both from internal factors from KIP itself and external factors, namely from disabled voters themselves. However, the Lhokseumawe City KIP has carried out these two tasks quite well in accordance with the mandate of statutory regulations. The right to vote and the right to accessibility are the two rights of voters with disabilities that must be fulfilled by the Lhokseumawe City KIP. In this case, the Lhokseumawe City KIP has several obstacles and efforts that have been implemented. To increase KIP's role in fulfilling voting rights and accessibility, it is recommended that KIP strengthen coordination with related institutions, including training for election officials on how to serve disabled voters well. It is also hoped that the public will be more aware of the importance of social inclusion in elections, so that voters with disabilities can maximize their voting rights.
