Abstract

Tindak pidana pembunuhan berencana di Gampong Ulee Madon Kecamatan Muara Batu Kabupaten Aceh Utara dalam Putusan Nomor 249/Pid.B/2019/PN.Lsk. selain melanggar Pasal 340 KUHP jo Pasal 55 KUHP juga melanggar Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, dan Undang-Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah tangga. Penelitian ini bertujuan untuk menganalisis penerapan sanksi pidana terhadap pelaku pembunuhan berencana di Gampong Ulee Madon Kecamatan Muara Batu Kabupaten Aceh Utara dan dasar pertimbangan hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana pembunuhan berencana pada studi Putusan Nomor 249/Pid.B/2019/PN.Lsk. Penelitian ini menggunakan jenis penelitian kualitatif dengan menggunakan pendekatan yuridis normatif, sifat penelitian deskriptif dan bentuk penelitian deskriptif kualitatif. Berdasarkan hasil penelitian diketahui bahwa: Sanksi Pidana Terhadap Pelaku Pembunuhan Berencana di Gampong Ulee Madon Kecamatan Muara Batu Kabupaten Aceh Utara Dalam Putusan Nomor 249/Pid.B/2019/PN.Lsk yaitu terdakwa Aidil Ginting telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana pembunuhan berencana yang melanggar Pasal 340 KUHP jo Pasal 55 ke-1 KUHP sehingga majelis hakim Pengadilan Negeri Lhoksukon menjatuhkan pidana hukuman mati. Pertimbangan Hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana pembunuhan berencana pada Studi Putusan Nomor 249/Pid.B/2019/PN.Lsk. yaitu terdiri dari pertimbangan yuridis dan pertimbangan non yuridis. Dasar pertimbangan hakim dari aspek yuridis adalah; Dakwaan Penuntut Umum, keterangan saksi, keterangan terdakwa, dan alat bukti. Sedangkan pertimbangan non yuridis yaitu dengan terpenuhinya seluruh unsur 340 KUHP Jo Pasal 55 ayat (1) KUHP, maka terdakwa Aidil Ginting telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana pembunuhan berencana. Majelis Hakim juga tidak menemukan adanya alasan pemaaf maupun pembenar yang dapat menghilangkan sifat pertanggungjawaban pidana pada diri dan perbuatan terdakwa sehingga majelis hakim Pengadilan Negeri Lhoksukon menjatuhkan pidana hukuman mati terdakwa. Pidana hukuman mati tersebut majelis hakim juga telah mempertimbangkan aspek filosofis dan aspek sosiologis. Disarankan setiap institusi penegak hukum untuk mempertahankan penerapan hukuman mati demi melindungi kemaslahatan umat manusia secara umum. Diharapkan hakim harus lebih peka untuk melihat fakta-fakta apa yang timbul pada saat persidangan, serta dalam mempertimbangkan aspek yuridis dan non yuridis lebih teliti saat menjatuhkan sanksi pidana yang sesuai terhadap terdakwa. The crime of premeditated murder at Gampong Ulee Madon Kecamatan Muara Batu Kabupaten Aceh Utara in Decision Number 249/Pid.B/2019/PN.Lsk. in addition to violating Article 340 of the Criminal Code in conjunction with Article 55 of the Criminal Code, also violates Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, and Law Number 23 of 2004 concerning the Elimination of Domestic Violence. This study aims to analyze the criminal sanctions against perpetrators of premeditated murder at Gampong Ulee Madon Kecamatan Muara Batu Kabupaten Aceh Utara and the judge's considerations in sentencing perpetrators of premeditated murder in the study of Decision Number 249/Pid.B/2019/PN.Lsk. This study uses a qualitative research type using a normative juridical approach, descriptive research nature and qualitative descriptive research form. Based on the results of the study, it is known that: Criminal Sanctions Against the Perpetrators of Premeditated Murder at Gampong Ulee Madon Kecamatan Muara Batu Kabupaten Aceh Utara in Decision Number 249 / Pid.B / 2019 / PN.Lsk, namely the defendant Aidil Ginting has been proven legally and convincingly guilty of committing the crime of premeditated murder in violation of Article 340 of the Criminal Code in conjunction with Article 55 point 1 of the Criminal Code so that the panel of judges at the Lhoksukon District Court sentenced him to death. The Judge's considerations in sentencing the perpetrators of premeditated murder in the Study of Decision Number 249 / Pid.B / 2019 / PN.Lsk. consist of legal considerations and non-legal considerations. The basis for the judge's considerations from the legal aspect are; Public Prosecutor's indictment, witness statements, defendant's statements, and evidence. Meanwhile, non-legal considerations are that with the fulfillment of all elements of Article 340 of the Criminal Code in conjunction with Article 55 paragraph (1) of the Criminal Code, the defendant Aidil Ginting has been proven legally and convincingly guilty of committing premeditated murder. The Panel of Judges also did not find any excuses or justifications that could eliminate the nature of criminal responsibility for the defendant and his actions, so that the panel of judges at the Lhoksukon District Court sentenced the defendant to death. The panel of judges also considered philosophical and sociological aspects in the death penalty. It is recommended that every law enforcement institution maintain the application of the death penalty in order to protect the general welfare of humanity. It is hoped that judges will be more sensitive to seeing what facts arise during the trial, and in considering the legal and non-legal aspects more carefully when imposing appropriate criminal sanctions on the defendant.
